Q1.

Who is eligible for the SBCAP?
A1.   Any business with less than 100 employees. Larger businesses may be assisted if time allows.
Q2.   Is this program mandatory?
A2.   No. The SBCAP is a voluntary program.
Q3.   How does the SBCAP work?
A3.   A compliance assistance engineer will, at the request of the small business, perform an on-site visit and compliance review. The review will result in a letter to the business which discusses any non-compliance issues identified, potential corrective action measures, and pollution prevention opportunities that might reduce the businesses regulatory burden.
Q4.   Will a regulatory program inspector be sent out as a result of a compliance review?
A4.   No. The regulatory programs and the SBCAP are run entirely independently of one another. The compliance review is performed in confidence and will not be shared with the regulatory programs.
Q5.   Will I have to follow-through on the program's recommendations?
A5.   No. But we do hope that recommendations will be implemented.
Q6.   What if the compliance review discovers a violation?
A6.   As long as the non-compliance issue does not "threaten or cause substantial harm to the environment/public health" then the regulatory program will not be notified. Violations will be discussed in a compliance review letter which will be sent to the business. For a more detailed explanation please refer to the program's fact sheet.
Q7.   How much does a compliance assistance review cost?
A7.   Nothing. This program is fully funded by the Department of Environmental Conservation to assist small businesses.
Q8.   Is there a waiting list?
A8.   The program is operating on a first come, first served basis. Sign up as soon as you can to be assured assistance work will be done as soon as possible.
Q9.   If I do not want an on-site compliance review, but want information on compliance issues, pollution prevention, waste reduction, or recycling, where can I get it?
A9.   Simply call the Environmental Assistance hotline at 800-974-9559.
